These Terms of Use and Copyright Notice (these "Terms") govern your access to and use of byxiao.studio (the "Site") and all materials made available on it. By accessing or using the Site, you agree to be bound by these Terms.
- Copyright; Ownership. © 2023–2026 XIAO. All rights reserved. All materials on the Site, including without limitation photographs, images, video, artwork, text, and design (collectively, the "Content"), are the original works of the artist XIAO (the "Artist") and are protected by copyright. The Content is created in and across France, the United States (New York), and the People's Republic of China (Shanghai), and is protected under the laws of those jurisdictions and under applicable international copyright conventions, including the Berne Convention. Such protection arises automatically and subsists in every jurisdiction from which the Site may be accessed.
- Restrictions on Use. Except for viewing the Site in a web browser, no part of the Content may be copied, reproduced, republished, distributed, publicly displayed, modified, adapted, or used to create derivative or new works, in any medium or by any means, without the Artist's prior written permission. All rights not expressly granted are reserved.
- No Use for Artificial Intelligence or Data Mining. The Artist hereby expressly reserves all rights in the Content and prohibits its collection, reproduction, or use for text and data mining, machine learning, or the training, development, fine-tuning, or evaluation of any artificial intelligence or generative system, whether by automated crawler, dataset, or any other means. This Notice constitutes an express reservation of rights, including for purposes of Article 4 of Directive (EU) 2019/790 and any equivalent or successor law. No license for artificial intelligence or dataset use is granted, and none shall be implied or inferred from access to the Site.
- Downloadable Curriculum Vitae. The Artist's curriculum vitae is made available for download solely to permit curators, galleries, press, and prospective collaborators to review the Artist's professional background. Such download confers no right in the content of the curriculum vitae, which remains the property of the Artist and may not be republished, redistributed, or otherwise reused without the Artist's prior written permission.
- Mature Artistic Content. The Site presents fine-art works that may include nudity, depictions of the body, sexuality, gendered experience, queer experience, and other mature themes, all in an artistic context. By accessing the Site, you represent that you are legally permitted to view such content in your jurisdiction and that you access it voluntarily. If you are not legally permitted to view such content, you must leave the Site.
- Acceptable Use. The contact details provided on the Site and within the downloadable curriculum vitae are furnished for professional and press inquiries only. Unsolicited marketing, spam, and any harassing, threatening, abusive, or repeated unwanted calls, emails, or messages are prohibited and may be reported to the relevant platforms or authorities.
- No Interference. You shall not attempt to damage, disable, disrupt, overload, gain unauthorized access to, scrape in contravention of these Terms, or otherwise interfere with the Site or its security, by any means or method. Any such access or interference may violate computer-misuse and unauthorized-access laws in multiple jurisdictions and may give rise to civil and criminal liability.
- Third-Party Links. The Site may contain links to third-party websites, platforms, or resources. The Artist is not responsible for the content, policies, availability, or practices of any third-party site.
- No Warranty. The Site and its Content are provided for artistic, informational, and portfolio purposes on an "as is" and "as available" basis. The Artist does not warrant that the Site will be uninterrupted, error-free, secure, or free of harmful components.
- Limitation of Liability. To the fullest extent permitted by law, the Artist shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from access to or use of the Site or the Content.
- Enforcement. The Artist monitors for unauthorized use and reserves the right to pursue all remedies available at law or in equity for any infringement or violation of these Terms, in any applicable jurisdiction, including France, the United States, and the People's Republic of China, and on a cross-border basis under applicable international law.
- Permissions. Requests to license or otherwise use any Content may be directed to press@byxiao.studio.
- Changes. These Terms may be amended from time to time. The date stated above indicates when they were last revised.
